1. Scope

These Terms and Conditions of Sale (T&Cs) govern all purchases made on the website ilovenaya.com (hereinafter referred to as "the Website") operated by Naya (hereinafter referred to as "the Seller"). By placing an order, the Customer accepts these T&Cs without reservation.

3. Products

The products offered for sale are described and presented with the utmost accuracy. However, minor variations (e.g., colors, sizes) may occur due to technical limitations in the presentation.

Product Origin: Products are shipped directly from our partners based in China. The Seller cannot be held responsible for minor discrepancies between descriptions and the actual products received.

4. Orders

  • Orders are confirmed once payment has been validated.
  • The Seller reserves the right to refuse an order in case of disputes with the Customer or product unavailability.

5. Pricing

  • Prices are displayed in Euros (€), inclusive of all taxes (VAT), unless stated otherwise.
  • Delivery costs are shown prior to order confirmation.
  • The Seller reserves the right to modify prices at any time, but products will be invoiced based on the rate in effect at the time of order placement.

6. Payment

Payments are made online via secure methods such as credit card, PayPal, or Shopify Payments.

7. Delivery

  • Delivery Zones: Naya delivers internationally.
  • Delivery Times: Products are typically delivered within 10 to 20 business days due to shipping from China. These times are indicative and may vary depending on carriers and customs processes.
  • The Customer is responsible for providing accurate delivery information. The Seller cannot be held liable for delivery issues arising from incorrect information provided by the Customer.

8. Right of Withdrawal

In compliance with European consumer laws, the Customer has a 14-day withdrawal period starting from the date of product receipt to return products without justification.

To exercise this right:

  • Send an email to contact@ilovenaya.com with your order number.
  • Products must be returned in their original condition at the Customer’s expense.

Certain products, such as personalized items, may not be eligible for return.

9. Guarantees and Complaints

  • Products are covered by the legal guarantee of conformity and the guarantee against hidden defects.
  • If a product is defective or non-compliant, the Customer must contact customer service at contact@ilovenaya.com within 7 days of receiving the product.

10. Liability

The Seller cannot be held liable for:

  • Delays or delivery failures caused by carriers or customs processes.
  • Minor variations between product descriptions and the actual products received.

In cases of force majeure (e.g., strikes, pandemics), the Seller’s liability is also waived.

11. Intellectual Property

All elements of the Website (texts, images, logos, etc.) are protected by intellectual property laws. Unauthorized use or reproduction is strictly prohibited.

12. Governing Law and Dispute Resolution

These T&Cs are governed by French law.
In the event of a dispute, the Customer may seek free mediation through the European Online Dispute Resolution Platform (https://ec.europa.eu/consumers/odr/) or refer the matter to the competent courts.
